MOTHER FIGHTS BACK, AFTER FORCED C-SECTION, Patient Right # 6, The Right To Refuse Treatment

During the process of giving birth, Rinat Dray was in a vulnerable position. While trying to cope with labor contractions, she was wheeled to an operating room for a c-section, against her will. She is not a criminal; she is a mother. Yet her baby was forcibly cut out of her body during an invasive cesarean surgery, forced on her despite her refusal to consent and verbal outward cries for medical staff and Doctors to "Stop" the procedure and the mothers pleas. One can only shudder at the thought of being in such a terrible place.... 


Rinat Dray, mother of two, tried her best to attain better results with her third baby, finally found a "friendly" doctor who agreed to give her a fair trial of labor and agreed to let her deliver vaginally. Having what completely appears to be two prior -completely unnecessary -c-sections with her first two babies, this mother was clearly traumatized, and had sought different doctors each time, trying to achieve a better result than each previous birth. (She perhaps should of sought out a birth center or home-birth midwife) As the result of the 3rd Hospital delivery, seems to be even more alarming and traumatic than the first two, for this particular mom. 

After the Doctor who so very willingly agreed to perform a VBAC, decided he wasn't going to do it, and proceeded, along with hospital staff to what can only be called, bullying and forcing the mother into a c-section, while she verbally declined all throughout the process of the c-section pre-operation preparation, one can only shiver at the idea of what went on in this hospital and the trauma this mother endured. 

And can naturally only be happy she is suing the hospital and the doctors involved, although not happy this means higher and higher insurance rates for Midwifes and other service providers. 

The bottom line is, no matter what you and I may consider, safe or unsafe, smart of not smart, a woman who is in labor, has a right to REFUSE treatment, in fact ANY PATIENT for that matter, has the right to refuse treatment. No matter the outcome, it is the ability to CHOOSE which makes this country and any civilized country that recognizes human rights, great, and any country which reportedly claims itself to be based on the basic freedoms any human inherently owns, should thus, be so ashamed to force any patient, into treatment of any kind! Even if that means death for mother or child. You cannot make a choice of this nature for anyone. Because in your perhaps goodwill attempts to "save" you have harmed beyond your possible understanding, this entire family. The traumatizing of a mother and newborn to the degree that these doctors have traumatized them, will affect them for many decades now. Their ordeal is not over. 

Not only did they completely force a c-section on this mother, I mean, literally forced, not figuratively as in "she was talked into it...". literally as in she was begging not to be given an epidural, then begging not to be given a c-section. But the doctor also apparently damaged- as in cut-into her bladder. It angers me, because I wonder also, what kind of support system did this mother have? I would of helped her get out of there! You have a right to leave, Against Medical Advice, at ANY time, during your care, it is not for ME to chose, not for the Doctors to choose, it is YOUR choice and YOUR choice alone. 

The bottom line is, this is a clear case of abuse. The doctor and hospital lawyer wrote it plainly on Rinat Dray's records. “I have decided to override her refusal to have a C-section,” a handwritten note signed by Dr. James J. confirms it plainly. He felt he was above the mothers will and consent. 

I am disgusted at this incident. Clearly after a review of her records, there was still enough grounds to sue for a reason. I'm guessing there was no real danger to the baby or mother. Except the c-section of course. 

I am saddened as well. We must not stand for this. We must speak out and spread the word. 
The lawsuit that Mrs. Dray's Attorneys are filing is based on the agreed upon Association of Hospital's "Patients Rights" something that I hold dear and cover in my childbirth classes. I believe that truly understanding your rights can get you in better control over your own care. 

I highly recommend you become extremely familiar with them. 

Well, I hope I didn't' scare you, but rather enlightened you a bit about a couple of things. Maybe enough to save you some forced procedure being attempted on you while you're in your hospital bed. Sadly to say, I wouldn't be surprised.
